Netizen 168LLH, through the Chinese government website, asked Premier Li Keqiang a question about hazardous waste, stating: "Premier, hello! Currently, there is a shortage of hazardous waste treatment enterprises in our country, resulting in a significant gap in treatment capacity. This leads to many enterprises being unable to safely dispose of their solid waste, causing high disposal costs and increasing the burden on enterprises, hindering the smooth progress of national environmental protection work. It is suggested that the government issue policies to encourage social capital to actively invest in the solid waste treatment industry, and to handle the access procedures for solid waste disposal openly, fairly, and impartially, so that solid waste disposal can quickly form a favorable situation of local disposal, capable disposal, and reasonable prices."
Response from the Ministry of Environmental Protection:
I. Generation and Disposal of Hazardous Waste. According to statistics, in 2013, 31.57 million tons of industrial hazardous waste were generated nationwide, with 24.01 million tons utilized and disposed of, resulting in a utilization and disposal rate of 76.1%. By the end of 2013, there were 1728 units nationwide holding operating licenses for hazardous waste, with an approved operating capacity of 36.914 million tons/year. However, there are still problems such as uneven regional distribution of existing hazardous waste utilization and disposal facilities, with more than half of the country's hazardous waste treatment capacity concentrated in the relatively economically developed eastern regions. The utilization capacity for hazardous waste with high recycling value is sufficient, while the capacity for landfill and incineration disposal is clearly insufficient.
II. Unified Advancement of Hazardous Waste Disposal Facility Construction. In order to effectively guide local areas in carrying out hazardous waste pollution prevention and control work and vigorously promote the construction of hazardous waste utilization and disposal projects, in 2004, the State Council approved the implementation of the "National Construction Plan for Hazardous Waste and Medical Waste Disposal Facilities," to coordinate the construction of centralized hazardous waste disposal facilities and improve the capacity for hazardous waste disposal. In 2012, the Ministry of Environmental Protection, together with the National Development and Reform Commission, the Ministry of Industry and Information Technology, and the National Health and Family Planning Commission (formerly the Ministry of Health), jointly issued the "Twelfth Five-Year Plan for Hazardous Waste Pollution Prevention and Control" (huanfa [2012] No. 123, hereinafter referred to as the "Plan"). This plan identified the construction of three major key projects, including hazardous waste utilization and disposal projects, and proposed adhering to the principle of government guidance and market-led initiatives. It aimed to establish a diversified mechanism involving government, enterprises, and society, expand financing channels, and increase investment in hazardous waste pollution prevention and control. It required that local areas should combine local conditions and select a number of key projects to address prominent local environmental problems. The supporting measures required the improvement of economic policies and increased financial support. Specifically, it should implement the relevant provisions of the "Interim Regulations on Business Tax," further study and establish relevant tax and financial preferential policies, further implement and improve the hazardous waste and medical waste disposal fee system, and support the healthy development of the hazardous waste utilization and disposal industry.
Since the implementation of the "Plan," relevant national ministries and commissions and local areas have formulated and implemented a number of policies and regulations in accordance with the requirements. In 2013, the Ministry of Finance and the State Administration of Taxation issued the "Notice on Exempting Consumption Tax on Re-refined Oil Products from Waste Mineral Oil," exempting consumption tax on industrial oils such as lubricating base oil, gasoline, and diesel produced using waste mineral oil as raw material. In some regions, the business tax on hazardous waste and medical waste disposal fees collected by units holding hazardous waste operating licenses has been exempted; local areas have further implemented and improved the disposal fee system, and some regions have included medical waste disposal fees in medical service costs; most provinces have actively guided multi-party investment in the hazardous waste disposal industry, continuously increasing investment in hazardous waste pollution prevention and control through multiple channels.
III. Requirements for Handling Hazardous Waste Operating Licenses. In accordance with the requirements of relevant laws and regulations such as the "Law on the Prevention and Control of Solid Waste Pollution" and the "Management Measures for Hazardous Waste Operating Licenses," hazardous waste generating units should provide hazardous waste to or entrust it to units with corresponding operating license qualifications for disposal. Units applying for hazardous waste operating licenses should submit an application to the issuing authority before engaging in business activities, attaching the required supporting documents. The "Management Measures for Hazardous Waste Operating Licenses" mainly sets conditions for applicants in terms of personnel, transportation, facilities, planning compliance, and environmental protection procedures. It does not stipulate the nature of the business entity, and it encourages social capital to actively invest in the hazardous waste disposal industry. For units that meet the local hazardous waste disposal facility construction plan and the conditions for applying for a hazardous waste operating license, the environmental protection departments responsible for issuing licenses will handle them according to procedures.
