National Catalogue of Hazardous Wastes
Article 1 This catalogue is formulated in accordance with the relevant provisions of the "Law of the People's Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes".
Article 2 Solid wastes (including liquid wastes) with any of the following characteristics are included in this catalogue:
(1) Having one or more hazardous characteristics such as corrosivity, toxicity, flammability, reactivity, or infectivity;
(2) The possibility of hazardous characteristics cannot be ruled out, and may have harmful effects on the environment or human health, and needs to be managed as hazardous waste.
Article 3 Medical waste is hazardous waste. The classification of medical waste shall be implemented in accordance with the "Catalogue of Medical Waste Classification".
Article 4 Chemicals listed in the "Catalogue of Hazardous Chemicals" shall be classified as hazardous waste after disposal.
Article 5 Hazardous wastes listed in the Appendix "List of Exempt Management of Hazardous Wastes" of this catalogue can be managed under exemption in accordance with the provisions of the exemption content in the listed exemption stages and if the corresponding exemption conditions are met.
Article 6 The attribute determination of mixtures of hazardous wastes and other solid wastes, and the wastes after hazardous waste treatment, shall be implemented in accordance with the national standards for hazardous waste identification.
Article 7 The meanings of the terms in this catalogue are as follows:
(1) Waste category is the classification of hazardous waste based on the categories defined in the "Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal", combined with China's actual situation.
(2) Industry source refers to the industry where the hazardous waste is generated.
(3) Waste code is the unique code for hazardous waste, which is an 8-digit number. The first 3 digits are the hazardous waste generation industry code (determined according to the "National Economic Industry Classification (GB/T 4754-2011)"), the 4th-6th digits are the hazardous waste sequential code, and the 7th-8th digits are the hazardous waste category code.
(4) Hazardous characteristics include corrosivity (C), toxicity (T), flammability (I), reactivity (R), and infectivity (In).
Article 8 Solid wastes with unclear hazardous characteristics shall be identified in accordance with the national standards and identification methods for hazardous waste identification.
If identified as having hazardous characteristics, it belongs to hazardous waste, and its waste category should be determined according to its main harmful components and hazardous characteristics, and classified and managed according to the code "900-000-××" (×× is the hazardous waste category code).
If identified as not having hazardous characteristics, it does not belong to hazardous waste.
Article 9 This catalogue shall come into effect on August 1, 2016. The "National Catalogue of Hazardous Wastes" (Order No. 1 of the Ministry of Environmental Protection and the National Development and Reform Commission) issued by the Ministry of Environmental Protection and the National Development and Reform Commission on June 6, 2008, is hereby repealed.
